Thank you very much for your message.
All of our FU tags have been copied from en.wiki over the years. I have spent a great deal of time trying to put files and respective tags in order, but even if you give a break for a week, it all goes to waste.
The tag in question seems to be one of the tags we've not translated so far. But at that point I'm not concerned about it, since I am planning to propose/launch a major reorganization of the file issue in general, anything from policies and guidelines to files, tags as well as transfers to Commons.
As for laws, we are currently governed by US laws (unlike you guys). Turkish laws are much more restrictive than US laws, and even though fair use exists, its scope is also much more restrictive. Personally I am against Fair Use, and I do believe that it contradicts what we stand for. The community, however, seems to be fond of it, so FU will remain here for the time being. But we may consider switching to Turkish laws in the near future, that would sure be better for compliance purposes.
The image you refer to, File:Bursa-Yenişehir.JPG was a clear copyvio, and is no more :) Don't count on our tags, not until summer :) With FlaggedRevs and everything, we will have a much more healthier control system.
Anyway, I'll fix the template and make it say "Turkish Wikipedia" instead of "English Wikipedia". Please feel free to holler whenever you need to check the validity of tagging done by our local users here.

Me and my broken promises :( It's been almost 2 weeks for crying out loud! Sorry, sincerely...
I'll go step by step:
- File:Thy b777 new livery borak.jpg - I came across something last month, which was quite similar to what we have here. I spotted a Creative Commons file on Commons, of which the source said "All Rights Reserved" (again on Flickr). Uploader names were identical, exactly what we have here actually. Anyway, I tagged it, and an admin reverted my edit citing that it was the same uploader. I've always exercised caution in such cases, and required a crystal clear statement of permission during my patrolling days, but this is maybe just me being bureaucratic (I just took a look at my contributions on Commons, but could not see my edit. I think someone has deleted it afterwards). Long story short, I am now quite confused about what to do in such cases. I always tend to get rid of these files, but this precedent presents a dilemma for me. Maybe a Commons admin would have something to say about this.
- File:Thy_a330_borak.jpg - User has uploaded two files here. This is the second one, which appears like a professional shot by all means. Checking out the source, we see a Non-Commercial clause, which makes the file unsuitable for WMF projects. So I'll get rid of it right after you see my message.
Judging by his history, I think it's safe to say that the user in question is yet unreliable in terms of copyright adherence. I think I'll delete the first one as well just to be on the safe side. Our speedy deletion policy allows deletion based on suspicion of infringement, so I'll go with that.
If you have time, which is something I'd kill for these days, maybe you could talk to someone on Commons about this first case as well as the proper course of action. I sure would like to hear about it.
